Liability
Guests’ liability for their account is not waived and guests agree to be held personally liable in the event that any indicated person, group, company or association fails to pay all or part of any charges incurred.
Damage to House of Agnes property
We reserve the right to charge guests the cost of rectifying damage, caused by the deliberate, negligent or reckless act of the guest to the hotel’s property or structure. Should this damage come to light after the guest has departed, we reserve the right to make a charge to the guest’s credit / debit card, or send an invoice for the amount to the registered address. We will however make every effort to rectify any damage internally prior to contracting specialists to make the repairs, and therefore will make every effort to keep any costs that the guest would incur to a minimum.
Removal of House of Agnes property
We reserve the right to charge guests the cost of replacing any items that are removed from the premises by them without consent. The charge will be the full replacement amount of the missing item, including any carriage charges. Should the fact that the item is missing come to light after the guest has departed, we reserve the right to make a charge to the guests credit / debit card, or send an invoice for the amount to the registered address.
Tampering with fire detection systems and firefighting equipment
We reserve the right to take action against any guest found to have tampered / interfered with any fire detection equipment throughout the hotel, including detector heads in public areas and bedrooms, break glass points and fire extinguishers. Guests found to have tampered with any fire detection or firefighting equipment will be charged with any costs incurred by the hotel due to their actions and additionally may be asked to leave the hotel. Depending on the severity of the guest actions, the Police may become involved at the hotel’s discretion. Should the fact that firefighting or detection equipment had been tampered with come to light after the guest has departed, we reserve the right to make a charge to the guests credit / debit card, or send an invoice for the amount to the registered address.
Inappropriate Behaviour
It is the hotel’s policy that all our guests have the right to be treated with dignity and respect and as a responsible host we believe that we have a duty to our guests to protect them from inappropriate behaviour. Should any actions by a guest be deemed inappropriate by the Duty Manager, or if any inappropriate behaviour is brought to the attention of the Duty Manager, the hotel reserves the right, after any allegations have been investigated, to take action against the guest. Depending on the severity of the guest actions, the Police may become involved at the hotel’s discretion, or guests may be asked to leave the hotel.
Lost / Damaged property
Should any guest lose any belongings during their stay or incur damage to their property, the provision of the Hotel Proprietors Act 1956 will apply. If we find any lost property, we will make every reasonable effort to locate the owner and return it, but if we cannot locate the owner and an item is not reclaimed with 3 months of the guest’s departure it will be donated to a local charity.
Smoking Policy
No smoking is permitted in the hotel or on the premises other than in the designated smoking area which is located in the garden. There will be a cleaning charge of £100 for any guest that is believed to be smoking in the hotel. If a guest is found to be smoking in the hotel, the hotel reserves the right to ask the guest to leave the hotel premises.
We may retain your credit/debit card details and you consent to us debiting such amounts without prior notification. Should any damage be incurred by you (including cigarette damage and/or results of smoking in rooms) during your stay, these amounts may be debited from your card without prior notification.
Complaints or Comments
We take our guest satisfaction very seriously. Any complaint or comment regarding a stay at the House of Agnes should in the first instance, be addressed to the receptionist on duty at the time of your stay so that we can attempt to resolve it immediately. Problems that cannot be resolved then and there can be addressed to sandie@houseofagnes.co.uk
Child Policy
The House of Agnes recognizes children as being 12 or under. Please be aware that individuals over 12 will be classed as adults and charged accordingly on arrival. The House of Agnes does not accept children under the age of 6.
Pets
Pets are not permitted in any areas of the property, with the exception of guide or service dogs.
Check in / Out times
Check in and Check out times are explained when bookings are made.
Vehicles
Vehicles are parked at the owners’ risk. Should a problem occur with a vehicle the House of Agnes cannot accept any liability. If a vehicle is left on the property after the guest has checked out except when permission has been given, the management reserves the right to remove the vehicle at the owners’ expense.
Nothing in these terms or conditions shall limit or restrict the guests’ legal rights as a consumer. Advice concerning such rights may be obtained from a Citizens Advice Bureau.
Responsibility for guest’s property
The proprietor of any guest accommodation has a duty to take reasonable care of the property of his guests brought to the property. If it is lost or damaged through the negligence of the staff, the proprietor may be liable. The proprietor can avoid his liability only if he can prove that the loss or damage was caused by the guest’s own negligence.
Limitation of our Liability
We do not exclude or restrict our liability for death or personal injury arising from our negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: your use of, or inability to use, our site; the failure of our site; the interception of data transmitted to or from our site; or your use of or reliance on any content displayed on our site.
If you are a business user, please note that in particular, the House of Agnes will not be liable for: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.
Although we take every precaution to protect ourselves and our users we will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or downloading of any content from it or any website linked to it.
Different limitations and exclusions of liability may apply to liability arising as a result of the supply of any accommodation or other services to you.
